The crime of femicide in Peru: legal analysis in relation to the active subject of the criminal offense

The objective of the investigation was to carry out a comprehensive legal examination of femicide, with attention to the active subject of the criminal type, for this a jurisprudential and doctrinal study was established, the type of research that was used is a qualitative approach, analytical method, hermeneutic design, and use was made of dogmatic sources through triangulation, from the analysis of jurisprudence (Plenary Agreement; Appeal for Annulment, Cassation, File of the Constitutional Court) the results were obtained that the crime of femicide in Peru can be executed by a man or woman regardless of their sex, this is based on the non-compliance with a gender stereotype in relation to the social and cultural context, the teleological interpretation of the norm that is based on providing protection to women from sexist behaviors that can be manifested by both sexes, the criminal offense does not establish an express restriction to consider solely and exclusively the male as the active subject of the crime. In conclusion, stating that women cannot commit femicide would violate the principles of legality and culpability, since it would impose a penalty on men not only for their conduct but also for their biological condition, which is unacceptable in a state governed by the rule of law.
