The process of intestate notarial succession and the right to inheritance

The objective of this article was to study the problems that arise in the notarial intestate succession process. The methodological approach is qualitative in nature in the sense that jurisprudential casuistry has been used as the main study instrument. Among the most important findings, it is highlighted that in the processing of the notarial intestate succession process, legal problems of special relevance are generated. For the present investigation, a total of six are reported, which have something in common, that is, the affecting the right to inheritance in a temporal sense, given that they do not prevent this right from finally being materialized, rather representing an argument to consolidate the thesis of the need for a testamentary culture which would at the same time generate legal certainty.
