Creation of a regional conservation area and the right to communal property in a native Peruvian community

Communal property rights within regional conservation areas are a very latent problem that encompasses territorial conflicts in the Peruvian jungle. The objective was to determine how the creation of the Cordillera Escalera Regional Conservation Area is related to the violation of the right to communal property of the Kichwa Nuevo Lamas Native Community. A descriptive correlational study was applied with a non-experimental quantitative approach. The sample population consisted of 50 community members. An observation guide and the survey were used as instruments. Among the results, through the Pearson test, a correlation coefficient of 0.655 stands out, with which the hypothesis is accepted regarding the violation of the right of communal property and the partial recognition of the ancestral territory of lands of agricultural aptitude, considering a risk to their own subsistence. It is concluded that there is an impairment of the right to native communal property to the extent that the constitutionally protected content of the right to communal property is unknown.
