Technical Defense in Desertion Crimes: Military Police Jurisdiction No. 28, Tarapoto

The research addressed the problem of procedural overload in crimes of desertion within the Military Police Jurisdiction No. 28 of Tarapoto, evidencing critical deficiencies in the technical defense during judicial processes. The study, developed through a qualitative approach and documentary analysis of seven files corresponding to the period 2023-2024, revealed a systematic pattern of judicial resolutions that prioritize administrative efficiency over a comprehensive defense. The results showed significant disparities in sanctions, with civil reparations ranging from S/. 200.00 and S/. 600.00 without clear justification, and a marked tendency of defense attorneys to accept procedural terms without exploring mitigating circumstances or individual contexts. The investigation showed that the abbreviated processes have been transformed into almost automatic mechanisms, where the military prosecuted are reduced to files, ignoring their human particularities. The conclusions demanded an urgent methodological review, proposing protocols that guarantee a more exhaustive and humanized evaluation of cases of military desertion.
